Whitney Woods Homeowners' Association, Inc. v. Steagall
Columbus, Franklin · OH · Ohio Court of Appeals, Tenth Appellate District
MIXED · hearings
What happened
Whitney Woods HOA sued the Steagalls over Declaration violations (and related disputes including a HUD discrimination claim referenced in proceedings). On summary judgment, the trial court held weekly fines were not properly chargeable because the association failed to give the Steagalls an opportunity to be heard on the fines, while other issues continued. Both sides appealed aspects of the judgment. On August 7, 2025, the Tenth District affirmed, including rejecting the Steagalls’ argument that the association waived enforcement of Declaration restrictions.
What the court (or agency) held
Mixed. Member-favorable piece preserved: weekly fines fell because the association did not provide the required opportunity to be heard. Association-favorable on appeal: Tenth District affirmed the judgment rejecting the Steagalls’ waiver-of-enforcement theory and related assignments of error as framed in the opinion. Overall affirmance left the hearing-based elimination of weekly fines in place while the association’s broader enforcement rights were not held waived.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Ohio fine fights often turn on hearing opportunity before weekly charges stick—summary judgment can wipe fines even when other restriction claims survive. Owners arguing ‘the board never enforced this before’ need a strong waiver/estoppel record; mere past presidential practice may not suffice on appeal.
What the member did
Contested chargeability of weekly fines for lack of an opportunity to be heard; that process defect was sustained in the affirmed judgment.
What did not work
Owners' appellate challenges to other aspects of the enforcement judgment failed; the association still recovered stipulated Declaration-enforcement attorney fees and costs (HUD-defense fees limited).
Questions for the board
- Before weekly fines accrued, did owners receive notice and a real opportunity to be heard under the Declaration?
- What fine schedule and hearing minutes support any continuing charges?
- Is the association relying on historical non-enforcement that could be argued as waiver?
- How are HUD discrimination claims being handled alongside Declaration enforcement?
Questions for a lawyer
- What hearing procedures does Ohio law / this Declaration require before fines are chargeable?
- After Whitney Woods, what remains of waiver arguments based on prior board practices?
- How should fine-invalidity holdings be separated from injunction or other restriction claims?
- What appellate issues remain if only fines—not other relief—were eliminated?
