Whalen v. 200 River Drive Condominium Association
Ramsey · MN · Minnesota Court of Appeals
MIXED · records
What happened
Michael Whalen refused a balcony-repair special assessment; the association liened and foreclosed; related sale/redemption followed. Whalen sued to invalidate the assessment/lien/foreclosure and for failure to provide association records about the balcony project. The district court granted the association summary judgment on all claims. On August 5, 2024, the Court of Appeals affirmed dismissal of the assessment/lien/foreclosure-invalidity theories but reversed in part, holding material fact disputes remained on whether the association met its statutory duty to respond to Whalen’s records requests.
What the court (or agency) held
Mixed. Association kept summary judgment on challenges that would wipe out the special assessment, lien, and foreclosure as a matter of law. Owner kept alive (for trial/further proceedings) the claim that the association failed to properly respond to statutory records requests about the balcony project. Nonprecedential opinion.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Fighting a special assessment and foreclosure is a different battle from records compliance. Even when assessment-invalidity claims fail on summary judgment, Minnesota CIC records duties can still present triable issues. Redeeming property does not necessarily waive a records claim.
What the member did
Identified discrete document categories and request dates with record evidence of ignored or misleading responses, preserving a statutory records claim even where assessment challenges failed.
What did not work
Challenges to assessment validity, lien, and foreclosure by advertisement after redemption—affirmed for the association.
Questions for the board
- What balcony-project records were requested, produced, withheld, and why?
- Where is the statutory timeline for responding to unit-owner records requests documented?
- How were special-assessment notices and owner voting/participation handled?
- What lien/foreclosure notices were sent, and is redemption complete?
Questions for a lawyer
- Which Minnesota statutes govern this association’s records duties on these facts?
- What evidence creates a fact dispute on incomplete records production after Whalen?
- Does redemption waive assessment challenges, records claims, or neither?
- How should a member pursue records remedies without resting the whole case on voiding the assessment?
