United States v. Rutherford Tenants Corp.

New York, New York · federal · U.S. District Court for the Southern District of New York

HOA loss · fair-housing

What happened

Meril Lesser filed a May 2018 HUD complaint alleging Rutherford Tenants Corp. and board president James Ramadei refused to allow her emotional support animals and sought to terminate her occupancy; she later alleged retaliation. HUD charged discrimination/retaliation in January 2021; defendants elected federal court. The United States sued December 6, 2021. On August 15, 2024, a consent decree required substantial monetary relief (including $165,000 under FHA damages provisions referenced in the decree and $585,000 consideration tied to resolving related occupancy litigation), dismissal of the housing-court case Rutherford Tenants Corp. v. Lesser, adoption of RA/assistance-animal policies, and compliance terms—without admission of liability.

What the court (or agency) held

Defendants lost via consent decree (no liability admission, no trial verdict). The decree provides major monetary consideration to Lesser, ends the related eviction/occupancy court case on agreed terms, and imposes RA policy and FHA compliance obligations on the cooperative and board president.

Why this matters for members

Fighting ESAs while prosecuting occupancy termination can convert a pet dispute into an FHA accommodation-and-retaliation case with DOJ involvement and very large settlement dollars. Boards should separate legitimate lease issues from disability accommodations and pause punitive occupancy moves while HUD charges are pending.

What the member did

Filed a HUD disability-accommodation/retaliation complaint that led to a federal charge and DOJ litigation.
