United States v. The Dorchester Owners Association
Philadelphia, Philadelphia · federal · U.S. District Court for the Eastern District of Pennsylvania
HOA loss · fair-housing
What happened
HUD received unit-owner complaints that Dorchester Owners Association denied or delayed assistance-animal accommodations under a no-pets regime; HUD investigated and charged. The United States sued March 12, 2020, alleging FHA disability discrimination and a pattern or practice. A June 10, 2022 jury found a pattern or practice and FHA violations as to three persons (a married couple and another unit owner) whose assistance-animal accommodations were denied or unreasonably delayed, but found the United States had not proven the accommodation claim of one intervening HUD complainant. On January 25, 2023, the court entered final judgment: $37,431 compensatory damages to the married couple, a $1 civil penalty, and injunctive relief requiring prompt responses to assistance-animal requests, recordkeeping, and compliance with post-verdict policies for three years.
What the court (or agency) held
HOA lost at trial (with a partial non-proof). Jury pattern-or-practice and individual FHA findings supported damages and injunctive relief; one complainant’s accommodation claim was not proved. Final judgment imposed compensatory damages, a nominal civil penalty, and multi-year injunctive compliance.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Assistance-animal delays and blanket no-pet cultures can become pattern-or-practice FHA cases with jury verdicts—not only settlements. Boards need prompt, documented responses; partial defense wins on one complainant do not erase liability as to others or group-wide relief.
What the member did
HUD complaints by unit owners triggered the charge and federal enforcement case.
What did not work
United States did not prove the accommodation claim of one intervening HUD complainant.
Questions for the board
- What is the average time from assistance-animal request to written decision?
- Does the association’s policy still frame ESAs as banned ‘pets’ pending board grace?
- What records of accommodation requests and outcomes are retained?
- Have policies been updated since any HUD complaint or lawsuit?
Questions for a lawyer
- How does a mixed jury verdict (some claimants proved, one not) shape injunction and damages briefing?
- What injunctive terms and monitoring period did the final judgment impose?
- When does delay itself become an FHA denial of a reasonable accommodation?
- What evidence supports or defeats a pattern-or-practice theory in a condo ESA docket?
