Turtle Rock III Homeowners Association v. Fisher
AZ · Arizona Court of Appeals, Division One (later depublished)
MIXED · fines
What happened
Turtle Rock III HOA sued Lynne Fisher over maintenance/CC&R upkeep issues, sending repeated notices and levying fines beginning January 2014. After an evidentiary hearing (Fisher did not personally appear), the trial court issued an injunction to clean/repair and awarded $3,850 in penalties plus association attorney fees. Fisher appealed. In 2017 the Court of Appeals affirmed the injunction but reversed the monetary penalties and the fees award below. The opinion was later depublished by Arizona Supreme Court order (CV-17-0339-PR, 2018).
What the court (or agency) held
Mixed, and depublished. Injunction requiring property maintenance cleanup/repair was affirmed. Award of $3,850 monetary penalties and related attorney fees against Fisher was reversed (court found the penalty/fee judgment could not stand on the contractual/penalty theories presented; thirty-day cure issues were discussed but the penalty reversal rested on the enforceability analysis in the opinion). Because the decision was depublished, it is not citable as precedent under Arizona rules.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Even when a court will order an owner to fix maintenance conditions, daily/accumulated HOA penalties still must fit the CC&Rs and penalty law—stipulated-damage-style penalties can fail. Separately, depublished Arizona opinions are a warning flag: a helpful fine reversal may not be usable as precedent after Supreme Court depublishing.
What the member did
Challenged monetary penalties for lack of a promulgated fine schedule and related reasonableness and notice arguments.
What did not work
Injunction requiring cleanup and repairs was affirmed; the depublished opinion cannot be cited as Arizona precedent.
Questions for the board
- Do the CC&Rs authorize these fine amounts, and is there a promulgated fine schedule?
- Was each fine preceded by the contractual notice and cure period (e.g., thirty days)?
- Is the association seeking an injunction to compel repairs, monetary penalties, or both?
- What hearing opportunity was actually provided before penalties accrued?
Questions for a lawyer
- Are the monetary charges enforceable penalties or unenforceable stipulated damages under Arizona law?
- What is the citation status after depublishing, and how should this opinion be used if at all?
- Can the injunction stand while penalties and fee awards are attacked?
- What record of notice, cure time, and hearing appearance is needed to challenge fines?
