Steinberg v. Fiesta Homeowners Association, Inc.
Margate, Broward · FL · Florida Fourth District Court of Appeal
MIXED · records
What happened
Gary Steinberg requested official records from Fiesta Homeowners Association under § 720.303 and later sued in Broward County Court for statutory damages and declaratory relief over an incomplete response. The county court dismissed for lack of standing (claim treated as derivative) and, alternatively, for failure to make the pre-suit mediation demand required by § 720.311(2)(a), and sua sponte sanctioned him with attorney’s fees under § 57.105(1). On March 5, 2025, the Fourth DCA affirmed dismissal on the mediation ground (declining to decide the derivative-standing issue), but reversed the sanctions.
What the court (or agency) held
Mixed. Dismissal of Steinberg’s records suit affirmed because he did not make the § 720.311(2)(a) pre-suit mediation demand. The Fourth DCA did not decide whether a § 720.303 official-records damages/declaratory claim is derivative. It reversed § 57.105 sanctions: whether such a records claim is derivative was arguable (no cited case holding it must be derivative), and failure to satisfy a condition precedent is not a § 57.105(1) basis; inherent-authority findings were also insufficient.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Florida HOA records disputes often still require Chapter 720 pre-suit mediation before court. Skipping that step can end the case regardless of how strong the records theory looks. Courts should not rubber-stamp fee sanctions against owners on unsettled derivative-vs-individual questions when the owner alleges a personal incomplete response to a specific records request.
What the member did
Made a specific official-records request and sued under § 720.303 when production was incomplete.
What did not work
Skipping § 720.311 pre-suit mediation led to affirmance of dismissal.
Questions for the board
- What official records were requested, what was produced, and what remains outstanding under § 720.303?
- Was the owner offered or directed to statutory pre-suit mediation under § 720.311 before litigation?
- Does the association’s counsel treat individual records-damages claims as derivative, and on what authority?
- What written timeline and fees apply to inspection/copying requests?
Questions for a lawyer
- Was a § 720.311(2)(a) mediation demand made in the form the statute requires?
- Is there a viable path to refile after mediation, and what limitations issues arise?
- How should the derivative-standing argument be briefed after Steinberg’s refusal to decide it?
- What record is needed to defeat or avoid § 57.105 sanctions in a refiled records case?
