Kinnaird v. Morningview Homeowners Association, Inc.

Suwanee · GA · Court of Appeals of Georgia

MIXED · architectural

What happened

Alex and Jean Kinnaird, longtime Morningview residents in Suwanee, applied on May 22, 2022 to install 33 rooftop solar panels oriented away from the street. The architectural review committee denied the application under the Declaration's energy-conservation/exterior-modification provisions. The Kinnairds sued for declaratory relief. The trial court granted summary judgment for Morningview HOA. The Court of Appeals of Georgia reversed, finding genuine issues of material fact on interpretation/application of the Declaration to the solar proposal (Sept. 10, 2025)—not a final order compelling installation.

What the court (or agency) held

VERIFY / REVERSE SJ ONLY — not a final merits order that solar panels must be allowed. The Court of Appeals reversed summary judgment for the HOA in the Kinnairds' declaratory action over a denied rooftop solar application, holding genuine issues of material fact remained on how the Declaration's energy-conservation and modification rules applied. Remanded for further proceedings.

Why this matters for members

This result is MIXED — a partial win, not a clean sweep on every claim. Solar denials under ambiguous energy/ARC covenants may not be resolved on summary judgment when owners create fact issues about orientation, impact, and covenant meaning. Reversal of HOA summary judgment is an interim member-favorable result—not a guarantee of installation.

What the member did

Submitted a detailed ARC modification application with panel specs and placement rendering; sued for declaratory judgment challenging the denial and the HOA's reading of exculpatory Declaration language.
