Ironwood Owners Assn. IX v. Solomon
Riverside County · CA · California Court of Appeal, Fourth District, Division Two
MIXED · other
What happened
Owners (Solomons) planted eight date palms without architectural-committee plan approval under Ironwood's CC&Rs. The association obtained summary judgment for a mandatory injunction compelling removal plus declaratory relief. On appeal, the Fourth District (Div. Two) reversed the summary judgment, holding that before a mandatory injunction issues the association must show it followed fair procedures and that its decision was made in good faith and was reasonable—not merely that a technical CCR violation occurred (1986).
What the court (or agency) held
Before an HOA may obtain a mandatory injunction compelling an owner act, it must prove it followed its own fair procedures and that its substantive decision was made in good faith and was reasonable—not arbitrary or capricious. Summary judgment for a palm-removal injunction was reversed because those showings were not established as a matter of law. Mixed/member-favorable: procedural/substantive standards tightened; not a final merits win for either side.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Technical CCR violations alone do not automatically yield mandatory injunctions on summary judgment. Associations must prove fair process and reasoned, good-faith decisions—opening room to litigate selective or arbitrary enforcement.
What the member did
Challenged summary judgment by showing the association never documented a proper ACC/board decision under the CC&R standards before seeking removal by injunction.
What did not work
Owners still had to accept that landscaping of this kind required plan submission under the CC&Rs.
Questions for the board
- Before seeking a mandatory injunction, can we document that architectural procedures were followed and the decision was reasoned and evenhanded?
- Have similar unapproved plantings or improvements been tolerated elsewhere in the community?
- What hearing/notice did the owner receive before we sued for removal?
Questions for a lawyer
- What California authorities after Ironwood define the fair-procedure/reasonableness showing for mandatory injunctions?
- How should selective-enforcement evidence be developed to defeat summary judgment?
- What remedies short of tree removal might a court consider?
