What happened
Idaho homeowners complained that HOAs and a management company charged transfer fees never disclosed in governing documents. The Idaho Attorney General investigated under the Idaho Homeowners Association Act and Consumer Protection Act. On May 8, 2026, the AG announced Assurances of Voluntary Compliance with Pristine Springs HOA (Ada County), Armstrong Park HOA (Kootenai County), and Park Pointe Management Services (Ada County; ~70 HOA clients). Armstrong Park was required to issue refunds; the AG monitors fee practices under the agreements.
What the court (or agency) held
The Idaho Attorney General announced court settlements after complaints that HOAs and a management company charged transfer fees never disclosed in governing documents, contrary to the Idaho Homeowner Association Act and Consumer Protection Act. Idaho law requires explicit CCR disclosure of transfer fees; management companies lack authority to invent undisclosed transfer charges. Assurances of Voluntary Compliance and monitoring followed.
Why this matters for members
Undisclosed transfer/closing fees charged by HOAs or managers are AG enforcement targets when statutes require CCR disclosure. Multi-entity AVCs can force refunds and ongoing monitoring without a private trial.
What the member did
Homeowners filed consumer complaints with the Attorney General that triggered the investigation and settlements.
Questions for the board
- Are any transfer, resale, or closing fees charged to sellers/buyers, and where are they disclosed in recorded CCRs?
- If a management company invoices transfer fees, what contract and CCR authority supports those charges?
- How do we handle refund requests when fees were collected without CCR disclosure?
Questions for a lawyer
- What does the Idaho HOA Act require for disclosure and collection of transfer fees?
- How should owners document and complain to the AG or pursue private remedies for undisclosed fees?
- What does an Assurance of Voluntary Compliance typically require of settling HOAs/managers?
