What happened
In January 1973 the board of Fifty-Six Sixty Collins Avenue Condominium approved terrace installation of Rolladen shutters after a product demonstration. Virginia Dawson later contracted for and installed Shutters on her terrace, relying on that board approval and management/vendor communications. The association knew installation was underway and inquired about progress mid-1973 without stopping the work. It later sued to enjoin the shutters. After trial, judgment for Dawson on estoppel was affirmed; her cross-appeal on attorney fees was also affirmed against her (Jan. 24, 1978; rehearing denied Feb. 17, 1978).
What the court (or agency) held
The association was estopped from enjoining balcony Rolladen shutters after the board approved that product for terrace installations, the building manager and vendor communicated approval, and Dawson relied by contracting and installing. Trial findings establishing the elements of estoppel were affirmed; a late, inconsistent enforcement attempt could not unwind that reliance. Cross-appeal denial of attorney fees was also affirmed where fees evidence was not presented at trial.
Why this matters for members
This result is MIXED — a partial win, not a clean sweep on every claim. Board approval plus owner reliance can estop later inconsistent enforcement. Owners seeking fees must put fee evidence in at the merits trial (or obtain a proper reservation)—a post-judgment fee trial request may be denied.
What the member did
Relied on board approval of the shutter product and management/vendor representations; defended the injunction suit on estoppel.
What did not work
Post-judgment fee trial request without presenting fee evidence at the merits trial.
Questions for the board
- When we approve a product or alteration category, how do we document that approval so later boards do not reverse course unfairly?
- If installation begins after an approval, what prompt written notice process do we use if we believe the work is noncompliant?
- Do we keep minutes of product demonstrations and terrace/alteration approvals accessible to owners?
Questions for a lawyer
- What are the elements of equitable estoppel against an association under Florida law on facts like board approval plus reliance?
- How should fee evidence be preserved at trial when a declaration or statute has a prevailing-party fee clause?
- How do later Florida selective-enforcement cases interact with this estoppel holding?
