What happened
Patrick E. Jennison had a leaking cast-iron sewer lateral about two feet beneath the slab of his Newport Beach Dover Village condominium. After a roughly $15,000 trench-and-replace repair, the association billed him on an 'exclusive use common area' theory. On cross-motions for summary judgment the trial court declared the association responsible and later awarded Jennison about $17,000 in attorney fees and costs. The Court of Appeal affirmed: under a natural reading of the CC&Rs and Davis-Stirling, the lateral was common area the association must repair—not exclusive-use common area shiftable to the owner—and Lamden deference does not let a board decide pure legal questions of who owns/maintains an improvement.
What the court (or agency) held
A condominium sewer lateral beneath the slab that connects a unit to the main line was common area the association must repair—not 'exclusive use common area' shiftable to the owner—under a natural reading of the CC&Rs and Davis-Stirling. Lamden deference does not let a board decide pure legal questions of who owns/maintains an improvement. Judgment for Jennison (plus ~$17,000 fees/costs) and appellate fees were affirmed.
Why this matters for members
Boards cannot use Lamden deference to rewrite allocation of repair duties. CC&R and Davis-Stirling text on common area versus exclusive-use common area controls who pays for sewer laterals under the slab.
What the member did
Refused the repair invoice; litigated CC&R/Davis-Stirling text on cross-motions for summary judgment; obtained fees as prevailing owner.
Questions for the board
- Do our CC&Rs define sewer laterals under slabs as common area or exclusive-use common area?
- Before billing an owner for a major plumbing repair, have we matched the component to the recorded definitions?
- Are we treating legal allocation questions as discretionary maintenance calls?
Questions for a lawyer
- Is this lateral common area under the CC&Rs and Davis-Stirling?
- Does Lamden apply, or is the issue a pure legal ownership/maintenance question?
- What fee recovery is available to a prevailing owner?
