Beckett-Morales v. Scheuer
FL · Florida Second District Court of Appeal

What happened
Beckett-Morales owners obtained ARC approval conditioned on published waterfront-lot architectural guidelines, installed a privacy fence, then modified it after neighbor Craiger Scheuer complained about a stormwater-pond view (association-funded modification). Scheuer sued when the association would not force further change matching a contractor sketch. The trial court entered a summary-judgment injunction requiring fence alteration. The Second DCA reversed: the as-built fence complied with the declaration and guidelines (including guideline 5.C's height transition); the sketch Scheuer preferred would itself have violated those guidelines; and the documents did not guarantee water views for non-abutting lots.
What the court (or agency) held
The Second District reversed a summary-judgment injunction that would have forced owners to modify a privacy fence to restore a neighbor's pond view. The existing (association-funded modified) fence complied with the declaration and published waterfront-lot architectural guidelines (including guideline 5.C's 10-to-16-foot height transition). The contractor sketch the neighbor preferred would itself have violated those guidelines, and the governing documents did not guarantee water views for non-abutting lots. Forcing more exposure than the documents require improperly impairs the owners' lot enjoyment.
Why this matters for members
Architectural disputes turn on the recorded/published standards—not neighbor preferences. An injunction cannot require owners to violate the guidelines that actually govern the lot type.
What the member did
Obtained written ARC approval conditioned on published guidelines; showed the as-built fence met guideline 5.C after association-funded modification; argued no covenant language guaranteed the neighbor's view.
Questions for the board
- Does the as-built improvement match the written guidelines for this lot type?
- Do our documents create any express view rights for non-abutting lots?
- If we funded a modification, does that reflect approval of the current configuration?
Questions for a lawyer
- Do the declaration and published guidelines authorize or forbid the requested fence change?
- Is a neighbor's view preference enforceable as a covenant right?
- What record defeats summary injunctive relief requiring further alteration?
