Alhambra Homeowners Association, Inc. v. Asad

What happened

Alhambra Homeowners Association sued the Asads over unapproved house paint without completing section 720.311 pre-suit mediation. The Asads moved for summary judgment on that condition precedent; the association voluntarily dismissed without prejudice, later mediated unsuccessfully, refiled, and ultimately obtained compliance (the Asads paid $1,000 in fines and repainted). Separately, the Asads sought prevailing-party attorney's fees for the dismissed first action under § 720.305(1). The trial court awarded $8,146; the Fourth DCA affirmed and certified conflict with Simmons v. Schimmel.

What the court (or agency) held

When an HOA voluntarily dismisses without prejudice a covenant-enforcement suit after owners raised failure of section 720.311's mandatory pre-suit mediation condition, the owners are prevailing parties entitled to section 720.305(1) attorney's fees for that first action—even if the association later mediates, refiles, and ultimately obtains compliance. The Fourth DCA affirmed an $8,146 fee judgment for the Asads and certified conflict with Simmons v. Schimmel. Separately, the Asads later paid fines and repainted, so the overall dispute was not a pure merits win for the members. MIXED.

Why this matters for members

This result is MIXED — a partial win, not a clean sweep on every claim. Skipping mandatory pre-suit mediation can make the association the losing party on fees for that case even if it later refiles and wins compliance. Procedure failures have fee consequences independent of the paint merits.

What the member did

Raised the statutory mediation condition precedent and sought prevailing-party fees after the association's voluntary dismissal.

What did not work

In the refiled suit the owners ultimately paid fines and repainted; fee recovery was limited to the dismissed first action.
